Children and the Young Offenders Act 1997
A child who is dealt with by warning, caution or conference under the Young Offenders Act 1997 (NSW) cannot have a conviction recorded against them.
Records of Youth Justice Conferences and cautions may be taken into account by the Children’s’ Court when sentencing the child for another offence, but cannot be taken into account by an adult court.
